Sex Crimes

Child pornography - first time offenders found guilty of child pornography may be sentenced  to fines and between 15 and 20 years in prison. Both federal and state law apply.

Rape -The term rape generally refers to nonconsensual sexual intercourse by physical force, duress or threat of injury go the victim. This law has been modified so that gender and marriage are not relevant. To convict someone of rape some form of penetration has to occur and for each penetration another count can be added. There are of course many defenses and exceptions to the law-- one common defense is that the individual has engaged in consensual sex with the victim in the past.

Statuary rape- this refers to sexual intercourse with a minor, someone below the "age of consent".  Many states only view it as a felony if the offender is at least three years older than the minor, otherwise it is a misdemeanor. In NY the age of consent is 17.

Prostitution- known to most as the "oldest profession," prostitution is the act of exchanging sexual favors  for compensation. Prostitution is illegal in all states except certain parts of Nevada.

Solicitation - someone who pays for sexual services may be charged with solicitation of prostitution. In most cases this charge is a misdemeanor. This crime occurs at the moment you agreed to pay for sex and then take some sort of action to further that agreement.

Sexual assault - this refers to crimes where sexual touching is unwanted. Assault/battery to attempted rape, fall under this category. A judge can sentence anywhere between 2 to 7 years in prison.

Indecent exposure- it is a crime to display once genitals in public causing others to be alarmed.  this usually is done by the offender to receive sexual gratification for the  for first-time offenders this can be a misdemeanor with a few months in county jail and a fine. Urinating in public falls under this category but may hold little baring because it was not the individuals intent to expose themselves for sexual pleasure.

Crimes fall in different categories under the laws of New York and are subject to certain guidelines when it comes to sentencing depending on the nature and circumstances of the crime. See New York's sentencing guideline.
