Domestic Violence, Abuse

Domestic battery:

Domestic battery, as the name states, is when a physical altercation occurs in which physical pain was suffered. A heated argument is not enough. If a victim was not physically touched or felt pain by touch, it is not battery.

States vary in what they consider domestic relationships some states limit a domestic relationship to people who are married or from one family like a spouse children or parents other states have brought a new definition to include anyone dating or those who have dated in the recent past.

Due to the broadness of this crime the punishments are just as broad they range from misdemeanor probation's to felony imprisonments the act itself and the offenders History are taking into account a first-time offender might get a lesser punishment than that of a repeating offender with history of similar crimes. For aggravated domestic battery or assault punishment can be up to 15 years in prison.

Child abuse

Many people assume that child abuse is the physical act of striking a child. This information is false. Omissions or things that were not done for a child protection can land you a felony charge. Child abuse is one of the few felony offenses that a person can be punished for failing to do something. A parent, nanny, babysitter or anyone else who is taking over as a caretaker, can be subject to charges if wrongdoings occur.

Depravation of water or food, and  inadequate or poor medical treatment, can subject you to a felony charge. There are no set punishments and penalties for convictions for child abuse because this is such a severe crime. Punishment vary drastically based on the evidence in each case presented in the court system. Contacting your lawyer for help is your best option.
