Public Nuisance Crimes

PUBLIC INTOX:

*New York has a law against public intoxication due to drugs, but merely being drunk in public is not a crime. A person can be arrested if they are a danger to themselves or to others.

PUBLIC URINATION:

* on any street

* sidewalk

*alley

* plaza

*park

*beach

*public building

* public facility, or any place open to the public or exposed to public view

PUNISHMENT
* community service and fines

 

OBSCENITY:

*appeals to the prurient interest in sex

*is patently offensive in light of community standards

*lacks serious literary, artistic, political, or scientific value.

*promotion of sexually oriented materials to minors and regulating their display to the public

*films that had little, if any, plot and were comprised of scene after scene of sexual intercourse, homosexuality, cunnilingus, and fellatio

*the production, advertisement, or sale of matter depicting anyone under the age of 18 engaging in sexual activities.

 

ILLEGAL DUMPING :

*dumping waste on public or private property that is not licensed or permitted to receive waste

*dumping waste, without a license or permit, into sewers or waterways

*allowing another to dump waste on one’s land, without being licensed to receive such waste.
