Trespass

A person is guilty of trespass when he knowingly enters or remains unlawfully in or upon premises.

3rd degree:

*Includes fenced or enclosed spaces designed to exclude intruders

*elementary or secondary schools

 

2nd Degree:

A person is guilty of trespass when he knowingly enters or remains unlawfully in or upon a dwelling

* Any other type of school

 

1st degree:

* remaining in a dwelling or on the premises with a deadly weapon or explosive

*possessing a firearm
